Virtual Supervision: Expanding Access to Healthcare during the PHE

In response to the ongoing Public Health Emergency (PHE), the Centers for Medicare and Medicaid Services (CMS) has temporarily expanded the definition of “direct supervision” to include virtual supervision through real-time audio and video technology. This change has allowed more people to receive care by making it easier for healthcare professionals to provide services remotely.

Previously, direct supervision required the supervising healthcare professional to be physically present in the office suite during a patient’s visit. However, the temporary exception now allows for immediate availability through virtual presence. This change has facilitated the provision of telehealth services by clinical staff “incident to” the professional services of physicians and other practitioners.

This flexibility has been instrumental in expanding access to care for patients, especially those living in remote or underserved areas. The temporary exception for virtual supervision will expire on December 31, 2023.

By leveraging technology to provide virtual supervision, healthcare professionals can continue to deliver high-quality care to patients, even during times of crisis. This change has allowed more people to receive the care they need while minimizing the risk of exposure to COVID-19.
